Terms of Service
1. introduction
The following Terms of Service define the conditions under which apartment accommodation bookings may be made. Making a booking is equivalent to accepting the Terms of Service. The administrator of the reservation system is inTurs.net Ireneusz Bogdan, registered at 29/1 Radziwilowska St., Krakow, hereinafter referred to as inTurs.net. inTurs.net does not provide hotel services and therefore is not a contract party. The rental contract is entered into between a provider of hotel services in property, hereinafter referred to as the owner, and a user of the reservation system, hereinafter referred to as the guest.
2. reservation with a booking deposit
To make a reservation with a booking deposit the guest should fill in the reservation form provided on the website. The guest is obliged to pay a deposit of 30% of the total rental costs to secure the apartment. The deposit can be transferred to the bank account provided in the e-mail approving the reservation or paid by credit card, according to the method of payment chosen on the website.
a) Bank transfer
In case of bank transfers, the guest is automatically sent an e-mail approving their reservation with a booking deposit. The e-mail contains the bank account details into which the deposit must be transferred within 72 hours from the moment of making a reservation. Having transferred the deposit to the bank account the guest must confirm the payment by clicking on the specific link provided in the e-mail approving their reservation with a booking deposit. Failure to confirm the payment within 72 hours cancels the reservation.
b) Credit card payment
In case of credit card payments, the deposit must be paid within 20 minutes from the moment of making a reservation by clicking on the specific link. Failure to make a credit card payment within 20 minutes cancels the reservation.
The booking deposit cannot be reclaimed. After receiving the deposit, the guest is sent, as a confirmation of their payment, an e-mail with a link to an electronic booking voucher with all check-in details, in particular the contact details of the person responsible for the keys to the accommodation. On arrival the guest is obliged to pay the remaining amount of the rental costs to the person responsible for the keys.
3. RESERVATION WITHOUT A BOOKING DEPOSIT
Some apartment properties may be booked without a deposit payment. These are clearly specified on the website. On arrival the guest is obliged to pay the total rental costs to a person responsible for the keys. To make a reservation without a booking deposit the guest should fill in the reservation form provided on the website. The guest is obliged to confirm their booking either by mail/fax or by credit card to secure the apartment:
a) Confirmation by mail or fax
Choosing this option the guest should print, sign and send by mail or fax the document called CONFIRMATION FORM provided in the e-mail approving the reservation. Failure to confirm a dispatch of the document within 72 hours cancels the reservation.
In case of cancelling a reservation within 16 days of the scheduled arrival date the guest must pay a cancellation fee, the amount of which varies according to the table below. The cancellation fee shall be paid to the inTurs.net bank account within 7 days of the cancellation date.
b) Confirmation by credit card
Choosing this option the guest should enter their credit card details into the specific form on the secure website no later than 20 minutes after having made a booking. The credit card is not charged on booking and no amount is taken in advance. The credit card serves as a guarantee in case of cancelling a reservation.
In case of cancelling a reservation within 16 days of the scheduled arrival date the guest authorises inTurs.net to charge a cancellation fee to their credit card, the amount of which is calculated using the table below.

4. 'LAST MINUTE' RESERVATION
A 'last minute' reservation is a reservation made within 5 days of the scheduled arrival date. In case of a 'last minute' reservation a booking deposit is not required. On arrival the guest is obliged to pay the total rental costs to the person responsible for the keys. To make a 'last minute' reservation the guest should fill in and send the reservation form provided on the website. The guest is obliged to confirm their reservation over the phone within 2 hours from the moment of making it. If a reservation is made after 10 pm Polish time, the guest must confirm it by 10 am the following day. The phone number to confirm a 'last minute' reservation is provided in the e-mail approving the reservation. Failure to confirm a 'last minute' reservation by phone within the specified time cancels the reservation.
5. Guarantee of the lowest price
All apartment properties presented on the website fall under the Lowest Price Guarantee Programme according to the conditions in the Program Regulations.
6. Loyalty program
All guests who use the inTurs.net reservation system become part of the loyalty program. In case of completing a stay booked through the system and expressing an opinion on that stay, the guest will receive a discount code entitling them to a 5% discount for every subsequent reservation made in the system by means of said code. The guest can use the code for themselves or give it to any other person who may want to take advantage of the discount. inTurs.net reserves the right to give the discount code to their guests in circumstances other than those mentioned above if inTurs.net recognizes the loyalty character of the guest's actions or decides that giving the discount contributes to promoting the reservation system.
7. non-refundable offer
Some apartment properties can be booked as the Non-refundable offer. These are clearly specified on the website. This offer is characterized by a lower price in comparison with the standard offer (p. 2, 3 and 4), but the full payment for the stay is required at the time of the booking and the payment will not be refundable in the event of cancellation by the guest, no matter what is the reason. However, if the cancellation is the fault of the owner, they are obliged to return the paid amount within 72 hours of the cancellation.
To take advantage of the Non-refundable offer, the guest should pay the full amount of the stay to the owner's account within 20 minutes from the moment of confirming the reservation by means of one of the online money transfers available on the web site (e.g. credit card payments, e-transfer). Failure to make the payment within the specified time cancels the reservation.
8. SCOPE OF RENTAL CONTRACT
The contract made between the owner and the guest comprises only and exclusively the act of renting. Travel arrangements, full board and an itinerary are the guest's responsibility. The total rental costs can be calculated on each apartment page of the inTurs.net website and all rates per night are displayed at the end of the reservation process. The total rental costs include utilities (gas, electricity, water) as well as the final cleaning service. The owner will not charge any additional fees other than those specified on the apartment page, except for charges for a stay with a pet (p. 11).
9. ARRIVAL, KEY COLLECTION, DEPARTURE
The guest should agree their arrival time at the apartment with a person responsible for the keys. One day before arrival or earlier, the guest is obliged to inform this person about their planned arrival time to collect the keys. The guest can check-in from 2 pm on the arrival day and must check out by noon on the departure day unless they agree different times with the person responsible for the keys or otherwise stated on the apartment site or in the booking voucher. If the guest is not able to arrive at the previously arranged time, they are obliged to contact the person responsible for the keys by phone immediately. The guest is obliged to pay the amount of money specified in the booking voucher, even though, for reasons independent of the owner, their arrival is delayed or the number of nights are reduced (i.e. transportation difficulties, strikes, personal reasons).
10. OBLIGATIONS OF THE GUEST
The number of occupants of the property is subject to the number specified in the booking voucher. In case of extra occupants the guest is obliged to contact inTurs.net by phone or by e-mail prior to arrival. If the number of occupants is greater than the number specified in the booking voucher, a person responsible for the keys is under no obligations to hand them over. The guest is obliged to observe the rules of good neighbourliness and to return the property in the same conditions they found it. Before the guest checks out they must wash up the dishes and all kitchen appliances as this activity is not included in the final cleaning service. The guest is obliged to inform the person responsible for the keys about defects and faults found in the property, if any, as well as to report all damage caused by them during their stay. The guest shall cover the full costs of any damage. The owner of the damaged property will decide the method of compensation.
11. RESERVATION AMENDMENTS
a) Change of date of stay
The booking deposit is non-refundable. The guest can change the dates of their reservation with a prepaid booking deposit provided that the change concerns the same property and the length of stay remains the same. The change can be made up to 14 days ahead of the scheduled arrival date. The guest must cancel the initial reservation by clicking on the specific link in the e-mail approving it, make a new reservation and provide the booking reference number of the cancelled reservation in the field 'Comments'. If the guest chooses dates for a more expensive season they are obliged to cover the difference in price on arrival.
b) Prolongation of stay
The guest can add nights to their booking. In order to prolong their stay the guest should contact inTurs.net by phone, write an e-mail or add a comment by clicking on the specific link in the e-mail approving their reservation.
c) Change of number of occupants
The number of occupants specified in the booking voucher may be changed provided that the total number of guests is within sleeping capacity of the chosen property. In order to make the change the guest should contact inTurs.net by phone, write an e-mail or add a comment by clicking on the specific link in the e-mail approving their reservation.
12.
TRANSFERRING THE GUEST'S RIGHTS AND RESPONSIBILITIES TO ANOTHER PERSON
At any time the guest may transfer all the rights of their reservation to another person if this person accepts all the duties resulting from the reservation. The guest is obliged to contact the owner immediately to inform them about the change and to give the contact details of the person who will assume the rights and duties of the rental contract.
13. COMPLIMENTARY STAY OF A CHILD
A child under the age of 5 (one per two adults) who shares sleeping arrangements with adults or is in a cot, and needs no additional bedding, does not have to pay a per-person rate during the whole stay. On making a reservation the guest states the number of persons in the reservation form excluding tany complimentary children but children's age must be provided in the field 'Comments'. Children other than those specified above must be counted among the number of occupants.
14. CHARGES FOR PETS
The guest may take with them small domestic pets, specifically a dog or a cat, unless otherwise specified on the apartment site. The charge for a pet is 10 PLN per night. The guest takes full responsibility for any damage caused by their pet and is obliged to compensate any damage. The owner of the damaged property will decide the method of compensation.
15. FORCE MAJEURE
In case of circumstances beyond the owner's reasonable control they reserve the right to provide substitute accommodation similar to the accommodation initially booked. The owner has the right to cancel the rental contract in case of events caused by force majeure. This also concerns cases where safety of the guest and their belongings, for reasons beyond the owner's control, cannot be guaranteed. The amount of money paid by the guest will be returned upon deduction of the amount charged for the service already provided.
16. JURISDICTION
In case of any conflicts between the owner and the guest Polish law is applicable. All legal proceedings shall be conducted by the competent court with a territorial jurisdiction covering the area where the owner has their headquarters.
